Pro. 2007-21) Excerpts Introduction On May 27, 2015, the Department of Health and Human Services published final rules in the Federal Register and the Federal Register Online that amends and restaffs several provisions of the Federal Food, Drug, and Cosmetic Act (FCA) including the FCA section defining the terms, “new drug applicator” and “old drug applicator.” These rules have been ongoing and were necessary as FDA had recently announced it had concluded the testing, pre-market registration and approval process for products containing bifenazate. The revised rule changes are the same as those published in December 2014 for “new drug applicators” and “old drug applicators” and add new definitions for certain additional terms. The new rule for the “new drug applicator” clarifies an issue raised in the 2012 Federal Register commentary, which is that the term “new applicant” referred only to a new manufacturer of medicines and not to a new company that has applied for FDA approval for a product containing bifenazate. The revised rule adds the term to the definition of “new applicant.” In the 2012 Federal Register commentary, the Agency stated that it had not found a need to clarify that the rule applies only to the application of drugs containing bifenazate to a new person.
